Terms of Service

These Terms of Service (“Terms”) govern your access to and use of https://aviationexampractice.com and any related services (collectively, the “Service”) operated by Aviation Exam Practice (“we”, “our”, or “us”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 15 years old to use the Service. By using it, you confirm that you meet this requirement. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Your account

• You are responsible for maintaining the security of your account credentials. Do not share your password.
• You must provide accurate information when registering. We may suspend accounts that contain false or misleading information.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at legal@aviationexampractice.com if you suspect unauthorised access.

3. Subscriptions and payments

Free trial

New accounts receive a 14-day free trial with access to all features. No credit card is required to start a trial. At the end of the trial period, continued access to paid features requires a subscription.

Paid subscriptions

• Subscriptions are billed in advance on a monthly or quarterly basis as selected at checkout. All prices are in Australian dollars (AUD) and include GST where applicable.
• Payments are processed securely by Stripe. We do not store your card details.
• Subscriptions renew automatically unless cancelled before the renewal date.
• You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then.
• We do not offer refunds for partial billing periods, except where required by Australian Consumer Law.

Pass Guarantee

If you complete at least one full mock exam per subject and score below the CASA pass mark on your real exam, we will extend your subscription at no charge until you pass. To claim, email us within 30 days of your exam result with your CASA candidate number and result. This guarantee applies to one claim per exam per person and is subject to our verification of reasonable usage.

Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.

4. Acceptable use

You agree not to:

• Share your account credentials or allow others to access your subscription.
• Scrape, copy, reproduce, republish or redistribute question content, explanations or theory notes without our written permission.
• Use the Service to develop or train any competing product or AI model.
• Attempt to circumvent any access controls, rate limits or security measures.
• Use the Service in any way that violates applicable Australian law.
• Upload or transmit any malicious code, spam or harmful content.

We reserve the right to suspend or terminate accounts that breach these rules without notice or refund.

5. Intellectual property

All content on the Service — including questions, explanations, theory notes, diagrams, software and design — is owned by or licensed to Aviation Exam Practice and is protected by Australian and international copyright law.

We grant you a personal, non-transferable, non-exclusive licence to access the content for your own private study purposes only. This licence does not permit commercial use, redistribution or reproduction in any form.

References to CASR, AIP, ERSA and other regulatory publications are made for educational purposes under fair dealing provisions. Those documents remain the property of CASA and their respective owners.

6. Disclaimer — not a substitute for training

Aviation Exam Practice is not affiliated with, endorsed by, or approved by the Civil Aviation Safety Authority (CASA). Content is provided for study purposes only and may not reflect the most current regulatory position.

7. Limitation of liability

To the maximum extent permitted by law, Aviation Exam Practice and its officers, employees and agents are not liable for any indirect, incidental, special or consequential loss arising from your use of or inability to use the Service — including loss of data, loss of profits, or costs of substitute services.

Our total liability to you for any claim arising under these Terms is limited to the amount you paid us in the 3 months preceding the claim. This limitation does not apply to liability that cannot be excluded under Australian Consumer Law.

8. Accuracy of content

We make every effort to ensure question content is accurate and current. However, aviation regulations change frequently. We do not warrant that content is complete, accurate or up to date at any given time. We review and update content on an ongoing basis; if you believe any content is incorrect, please report it using the flag function on any question.

9. Availability

We aim for high availability but do not guarantee that the Service will be uninterrupted or error-free. We may suspend the Service for maintenance, updates, or circumstances beyond our control. Where planned downtime exceeds 2 hours, we will provide advance notice where reasonably practicable.

10. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your access immediately if you breach these Terms or if we are required to do so by law. On termination, your right to access the Service ceases; we may delete your data in accordance with our Privacy Policy.

11. Changes to these Terms

We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not accept the changes, you must stop using the Service and may cancel your subscription for a pro-rata refund for the unused period.

12. Governing law

These Terms are governed by the laws of Queensland, Australia. Any dispute that cannot be resolved by good-faith negotiation will be subject to the exclusive jurisdiction of the courts of Queensland.
